英美政治法律制度的比较工业革命的浪潮使得全世界的生产力得到了飞速的提高，那时的英国作为产业革命的最大收益者之一，毫无悬念的成为了领导世界的霸主。而随着一战、二战的结束，人类在受到极大的创伤的同时，英国也丢失了自己世界霸主的地位。当然，即使是现在，任何人都无法忽视英国在政治经济文化方面对世界的影响力。无数的杰出的思想家、政治理论家、法律学者在英国诞生，引领了几个世纪的政治法律制度的发展方向。作为一个仅仅拥有几百年历史的国家，美国给世界政治法律制度史带来的，不仅是一次思想领域的革命，更是一场实践领域的革命。无论是她对三权分立理论的实践，还是她对人权内涵的扩大等问题的探讨，都成为近现代各国纷纷称赞、学习与效仿的对象。除去美国强大的经济实力不谈，她在政治法律制度上的世界影响力，也是至今为止世界上没有任何一个国家或地区可以超越的。政治制度（Political Regime）属于上层建筑范畴，一般是指与本国的社会性质相适应的国家权利机构和基本制度。法律所指的是一个国家用来规范国家各方管理的一个政策，在法律制度里，包含很多的法规和政策。广义的法律制度则是指在法律调整各种社会关系时所形成的体现社会制度的各种法律制度.它调整了多少社会关系就包含有多少种具体的法律制度如政治法律制度、经济法律制度、家庭法律制度、文化法律制度及狭义的法律制度等。我国现如今正处在国家转型的关键时期，学习并借鉴英美国家的政治法律制度来补充和完善本国的制度是十分重要的。比较两国政治制度的异同，能够加深对政治文明的理解，更加有针对性的加于借鉴。本着此精神，本文拟就英美的基本政治法律制度作一比较。一、英美宪法之比较宪法自问世以来，极大的推动了人类社会的文明进程。宪法在整个法律体系中居于根本法的地位,它是诸法中最具权威性的社会规范。宪法及其实施的状况是衡量一个民主国家的法制是否健全的重要标志。然而，在近现代宪法史上，许多的关于宪法制度最为基本的问题是在不断地宪法实践中才逐步找到答案，英美两国作为宪法制度的集大成之国，在许多问题上也存在者分歧。 1、成文法与不成文法成文法主要是指国家机关根据法定程序制定发布的具体系统的法律文件。不成文法（Unwritten Law）是指非经国家立法机关以特定程序制定的，亦不以条文化形式展示法律内容的，却具有国家法律效力的法律形式。它包括习惯法（Common Law）和判例法（Case Law）两种形式。不成文法主要不仅指判例，还包括惯例。成文法是“不成文法”的对称。国家机关依立法程序制定的、以规范性文件的形式表现出来的法，不成文法在法学上称为法的间接渊源。一些法学著作中也称为“非制定法”，其主要特点是未经立法程序，而非无文字记载。英美法系，又称为普通法法系，是以不成文法为特征的法系，但是在宪法采用何种形式时，英美两国产生了比较大的分歧。殖民地时代的美国对于英国法律的批判的焦点之一就是不成文法形式本身的弊病，因而当时美国许多的法律学家都倾向于采用成文法的形式制定一部稳定的、较为明确的宪法，以弥补不成文法本身的缺陷会给宪法制度带来的隐患，以确保宪法对人权的保护和对政府权力的有效限制，经过无数的美国宪法制度的开拓者们的争论和衡量，最终近现代世界上第一部成文的宪法诞生了。

中西方政府职能比较 ----甘肃省电大张掖分校张霞学号：LZ02022005063020016 摘要：政府职能是政府理论研究的重要内容。采用比较的方法,把握政府职能的轨迹,研究中西方政府职能的异同,对于厘清政府职能的基本内容,转变政府职能,构建中国特色的政府理论体系有着重要的理论意义。关键词：政府职能政府职能,是指政府根据社会发展需要而应履行的职责及其所应起的作用与能力。它反映着政府所代表的国家的阶级实质和活动的基本方向。政府职能不是一成不变得,而是随着经济、政治、文化、科学和社会的发展变化而发展变化的。总之,有什么样的社会需求就会有什么样的政府职能。政府职能转变主要包括三个方面的内容：一是政府职能重心的转变;二是政府职能行使方式、手段的转变;三是政府职能关系的转变。一、西方政府的主要职能（一）20世纪以前三权分立,资产阶级国家政治制度和政权结构的基本原则和组织形式。由十七世纪英国资产阶级唯物主义哲学家和政治学家洛克首创的,十八世纪法国著名的启蒙学家孟德斯鸠则发展和完善了这一理论。按照这一理论原则,政府职能分
