此外，我们理解，根据合同条件，需要质量保函

按照委托人的要求，我们据此不可撤销的承担支付给你不超过总金额USD140 546.25 的责任。

1）保证函中数量和日期项下的索赔，以及

2）你索赔的金额，以及

3）设备在设计，制造，材料或工艺上有瑕疵，以及

4）设备有瑕疵的方面，以及

5）你已经履行你合同下的义务，委托人不能对受益人履行其自己的义务，也不能免除责任

为了进行确认，你方书面署名需正式签字并通过当地银行的提示，你方书面要求的签字需被提示银行确认并证实，通过证实的SWIFT（或电传）发给我们来确认生效。

你方付款要求须随附LLOYDS或SGS这两家独立检验机构之一出具的证书，该证书证明货物为山东源和电站工程技术有限公司.所供应。委托人只是在设计，制造，材料或工艺上有瑕疵

本保函有效期至2011年5月7日。本保函项下任何付款要求和所需文件必须在本保函到期前按上述地址送达我方。本保函到期后，请将正本保函退回我方。但无论正本保函是否退回我方，本保函均告失效。

本保函在未经担保人书面许可的情况下，不允许转让或分配，也不允许用作抵押。多次提款是不允许的。

本保函依据国际商会即期保函统一规则（版本号485）。

保函产品介绍 一、保函概述 保函，英文名为Letter of Guarantee，一般由银行开立。它是根据申请人的请求，向受益人开立的书面保证文件，担保申请人如未对受益人履行某项义务、承担经济赔偿责任，则由银行作为担保人承担保函中所规定的付款责任。它被广泛用于国际贸易，在国际结算中占有重要的地位。由于其应用范围广、适用性强，所以目前也被越来越多地用于国内贸易。保函的基本当事人有三人，即委托人（申请开立保函的企业）、受益人（保函项下被担保人）和担保人（银行）。我行开立的保函遵循URDG（国际商会见索即付保函统一规则），从付款责任来说，我行承担第一性付款责任，从赔偿方式来说，属于无条件凭索付款，即只要保函受益人企业向我行提交声称对方违约的书面声明，我行在核实声明表面真实的情况下（即检验声明是否伪造）立即向受益人支付赔款，而不管对方是否实际违约以及申请人是否有能力偿付银行。 二、保函分类介绍 目前在我行叙做量较大、适用性好的保函品种大致有投标保函、履约保函、预付款保函、质量/维修/预留金/留置金保函、付款保函、关税保函、加工贸易税款保付保函、网上支付税费担保保函、借款保函。下面逐一介绍：
