8. ordered it to pay $25 000 9. An exact number of CDs and total damages will be determined at a November hearing 10. We believe that everyone should have the right to listen to the music they purchase

think about it

1. This is a controversial issue. On the one hand, those who are positive about it believe that downloading music for free is something that most of us have engaged in one time or another. It is certainly no high crime. Sharing music files online for free is a mini-consumer revolution and boon for artists — it is definitively ethical. On the other hand, those who are against it argue that it's no different from going into the artist's house and stealing his CD off the shelf. By stealing music, you are not only hurting musicians but also breaking the law.

2. This question has two different but valid answers. If one answers the question from a strictly legal point of view, copyright infringement is clearly not theft. It is only a violation of one or more specific statutes, violation is different from theft. In general, the legal definition of theft involves the unauthorized taking of another’s property. Even though we use the phrase Intellectual Property rather casually, making a copy of a protected work does not involve taking that property —it involves violating the owners’ right to control copying of the property. Others who are willing to rely on a more informal definition of the word “theft” assert that copyright infringement is theft. It may not meet the standard for statutory theft, but violating someone’s right to control copying at a minimum represents an ethereal opportunity cost, and in many cases tangible economic loss. To the person who finds their work stolen, the feeling of theft is quite real.

3. The purpose of copyright law is to promote the progress of useful arts and science by protecting the exclusive right of authors and inventors to benefi t from their works of authorship.

Passage A

John:W hy is it that people have such a difficult time following copyright laws?

Yang:T here are some countries in the world, John, where the average person cannot afford

entertainment or technology unless it is pirated and sold on the black market.

John:C opyrighted material is intellectual property. If someone violates these laws, they are violating the rights of those who created the music, software, movie, or idea. It is a blatant disregard for laws,

people’s rights, and an international moral standard.

Yang:H ow, then, do you propose to make entertainment and technology available to the masses in countries where the average income is lower than the poverty level in the United States? Are they

to be deprived of entertainment, aside from that created in their own countries?

John:I n America, not all people can afford entertainment and new technology, either. People must spend their money wisely and share with others. Violations of copyright laws keep the creators

from making their share of the profits for their own idea.

Yang:W hat should the United States do to prohibit American college students from downloading illegal music off the Internet?

John:T he US should work to protect people’s property and their right to information online.

Yang:I believe you are holding a double-standard, John. If people in the United States - who can afford entertainment - can download free music or buy cheap, fake goods, then why is it wrong for people

in poorer countries to do the same, just to have entertainment at all?

John:I t does not sound like a problem which can be easily solved, does it?

Yang:N o, it won’t be solved unless there is a global mandate to ease copyright protection laws or

Western companies prorate their prices to meet the income levels of poorer countries.

Fighting Against Piracy

Nowadays the problem of piracy has become increasingly serious. Not only is there a serious lack of knowledge amongst the general public about piracy issues, but there is also an attitude of indifference.

These days piracy is strongly evident in the commercial world in the wide availability of illegal softwares and DVDs, the inclusion of copyrighted pictures, web graphics, video clips and magazine portions in business presentations and the photocopying of books and articles for distribution without the author’s permission.

The negative consequences of piracy are two-fold. Firstly, the copyright owners are likely to suffer significant financial losses. Secondly, the copyright owner loses recognition, if the source of the material is unacknowledged.

Therefore it is important for all citizens to become educated about piracy issues, to follow copyright laws in their own lives, and to encourage their colleagues and friends to do the same.

Passage B

ASCAP(美国作曲家、作家与出版家协会)和BMI(美国音乐作品保护机构)也规定凡在公众场所播放受版权保护的音乐必须得到他们的批准,并声称这一规定适用于大多数商业环境。

(1)She admired her grandmother. (2)Negative. (3)To advertise his product (4)A daytime home burglary.

Dear Mr. Li,

On 12 May, I bought an MP3 branded as Moon Box, Model P, Product No. oq3001528, made by Huafeng Information Technology Development Co. Ltd. at your shop.

Unfortunately, when I came back home I found the product number printed on the box does not match with the number printed on the back of the player. The number on the box is oq3001528, but the number on the player is od3001528. I could not get registered with the number on the Net. And the player can only play in Pop, Normal and Rock modes. It cannot play in Jazz or Classic modes as it claims. Therefore I’m sure the player I bought is a f aked one.

To resolve the problem, I would appreciate if I could return the player and get my money back. Enclosed with the mail are copies of my records including receipts, guarantees, warranties, canceled checks.

I look forward to your reply and a resolution of my problem, and will wait until 14 June before seeking help from the Local Consumer Protection Association. Please contact me at the above address or by phone at my office (023) 6936****.

Sincerely,

Unit 5

4. 1. was sinking 2. specialty 3. purely 4. discourage 5. unlikely 6. dynamics 7. actually 8. reasonably 9. have perceived 10. extended 5. 1.took a deep interest in 2. fell into 3. sign up

Unit 1 The Evolving Notion of Home “Home, sweet home” is a phrase that expresses an essential attitude in the United States. Whether the reality of life in the family house is sweet or not so sweet, the ideal of home has great importance for many people. This ideal is a vital part of the American dream. This dream, dramatized in the history of nineteenth-century European settlers of the American West, was to find a piece of land, build a house for one’s family, and start a farm. These small households were portraits of independence: the entire family — mother, father, children, even grandparents — living in a small house and working together to support each other. Everyone understood the life-and-death importance of family cooperation and hard work. Although most people in the United States no longer live on farms, the ideal of home ownership is just as strong in the twentieth century as it was in the nineteenth. When U.S. soldiers came home after World War II, for example, they dreamed of buying houses and starting families. So there was a tremendous boom in home building. The new houses, typically in the suburbs, were often small and nearly identical, but they satisfied a deep need. Many saw the single-family house as the basis of their way of life. For the new suburbanites of the 1950s and 1960s, however, life inside their small houses was very different from life on a farm. First, the family spent much less time together in the house. The father frequently drove, or commuted, as much as an hour to work each morning. The children went to school all day and played after school with neighborhood children. The suburb itself was sometimes called a bedroom community because people used their houses basically for sleeping. Second, the suburb was not a stable community: Families moved frequently as the fathers sought upward mobility — better-paying jobs and bigger houses. Although the idea of home was still as precious as always, it had taken on a different meaning. In the 1970s and 1980s, as more women entered the labor force, the family spent even less time together. But the picture is changing: People can now telecommute, or work at home, while being linked to the office by means of their computers. More and more people can now stay at home. So the old expression could change from

Read and translate 1. He has no longer written to his friends ever since he got a mobile phone. Even though he is very busy, he spends at least two hours every day surfing the Internet, aiming to know about the latest development in this area / field. 3. Professor Li made a short speech at the commencement, his words of which were deeply impressed upon my memory. 4. Talking of the final exams the students were not nervous at all.
