关于专利的专业英语翻译经验
坛主点题，我就结合我翻译的实践和在论坛上对一些提问的解答，在此重点谈谈翻译时词典的运用。 我们做专利翻译的，英语基础和专业知识都应该是不错的。但我要指出，翻译时还是要勤查词典。不但要勤查专业词典，而且要勤查非专业词典，如《新英汉词典》或者金山词霸。 先说说查专业词典。我们都学过某门专业，有一定的专业知识。但专利翻译专业涉及面很广，例如在化学类，就有化工、食品、化学药、生物药、材料等各主要分支。我们对翻译的专利所涉及的技术领域往往是既有所了解，实际上又知之不深。翻译时除先查阅有关资料，了解相关知识之外，还要勤查专业词典，对专业词典切莫望文生义。 专业词语往往是复合词，复合词中的每个单词我们也许都认识，如果按每个单词的意思来翻译复合词，而不用专业词典加以查证，往往会发生错误。例如，“number theory(数论)”如果按单词number(数字)和theory(理论)译成“数理”就错了。又如“protein isolate”望文生义地翻成“蛋白分离物”就不够专业，在食品工程中叫“分离蛋白”。因此，对专业复合词，如果没有见过或不确定，要将其整体作为一个单词来查专业词典确定其准确词义。有人曾提问道：“schema tic sectional view 一般翻为剖面示意图，那么， schematic cross sectional view 中的cross怎么译呢？”。这就是把“cross”单独看待，而不会把“cross sectional”当作一个整体来查。我回答道：“"cross sectional "《英汉化学化工词汇》释义为“截面””。原来这样就可以查到的啊！ 一些词汇在各专业分支中有不同的意思。例如cleave在分子生物学中是“切割”的意思，在化工中是“裂解、断裂、裂开”的意思。具体翻译中采用“裂解、断裂、裂开”中的哪个词，也要根据上下文而定。因此，不要在一篇专利翻译中认识了某个专业单词的意思，在以后的专利翻译中还认为它总是这个意思。如果不确定，最好再查词典，也就是说，一个单词，可能不是查一次词典就完全掌握它的。 另外，一些专业词汇不一定能在专业词典中查到。除了多查几本词典多方考证，利用google搜索之外，有时候根据单词的词形或含义从侧面考证，也能得到意想不到的结果。例如有人曾提问道：““male part, female part”中的 male 和female如何翻译？”我查《英汉化学化工词汇》查不到这两个词。但找到相关词汇：male die 阳模，female die 阴模，male fitting 阳模配合，male flange 凸面法兰，female flange 凹面法兰，female thread 阴螺纹、内

专利术语中英文对照及解释 Assignee 专利权受让人： 在专利的领域内，专利权受让人指的是专利所有权人。专利权受让人可做是否出让或转售专利等决定。 Best Mode 最佳实施例： 最佳实施例是发明人在申请专利当时，认为可以实施发明最好的方式，美国专利法中要求说明书中必须要记载最佳实施例。 Certificate of Correction 补正书： 补正书是美国专利局用来订正专利中拼字或打字错误的文件。 Continuation Application 延续案： 延续案为较早的申请案（称为母案）还在审查期间所提出的申请，并使用母案申请日来作为优先权日，可以说是母案的延续。通常提出延续案的目的是为了申请不同于母案的请求项范围。 Continuation-in-part (CIP) Application 部分延续案： 部分延续案为较早的申请案（称为母案）还在审查期间所提出的申请。通常提出部分延续案的目的是为了加入母案没有揭露的特征以及申请不同于母案的请求项范围。其中，沿用母案的特征部分可主张母案的优先权日。 Continued Prosecution Application (CPA) 延续审查案： 延续审查案通常会在申请人收到最终核驳后的六个月内提出。通常提出延续审查案的目的是为了延续审查。另外，延续审查案并不能用在2000年5月29日起申请的「发明专利申请案」或是「植物专利申请案」，新式样专利并没有在此限。Claim 请求项或称权利项： 请求项是用来定义专利的保护范围的部分。 Defensive Patent 防御专利： 有的人申请专利的目的并不在于主动攻击竞争对手，而是希望将来被控告专利侵权时，可以利用这些专利保护自己并予以反击。在这种状况下，竞争对手在考虑控告侵权前，由于害怕将来被对方以这些专利反控侵权，常会因而打消控告的念头。这样的专利由于具有防御的功能，因此称为防御专利。 Declaration 声明书： 声明书是申请美国专利时需缴交的文件，发明人必须在文件中声明自己为真正的发明人、声明已阅读和了解说明书内容，以及会向专利局揭露任何与申请案专利性有关的技术资料。在声明书中作假会遭受罚金或坐牢的处分。发明人也可缴交宣誓书取代声明书，与声明书不同的是，宣誓书必须有公证人作证签名。 Design Patent 实用新型专利： 实用新型专利为保护物品的外观的专利。可申请实用新型的设计包括新的、具有原创性的物品外观设计。 Disclosure Document Program 文件揭露程序： 发明人可利用美国专利局所提供的「文件揭露程序」，以书面方式将发明描述出，并寄给专利局盖印保管，作为日后证明发明构思日（Conception of the Invention）的依据，费用为美金35元。需注意的是，判断「先发明」与否并不是
