四、租赁标的:The premises:

甲方同意将位于深圳市南山区南海玫瑰花园三期大厦/花园x 座/栋/阁x 层x 单位,建筑面积x 平方米,房地产证号码为深房地字第2号(以下简称“该物业”)的房屋及其设备(见附件)在良好状态下租给乙方作为住宅使用。

Party A agrees to let the premises located at 1F, block5 ,Rose Garden 3 , Shenzhen (hereinafter refers to as the premises) and the attached facilities (see in schedule) in good condition to Party B for the purpose of 4000353382, which measures 262 square meters (gross floor area). The ownership certificate number of the premises is for living .

五、租赁期:Term of tenancy:

5.1租赁期为12 个月,从2012 年01月01 日起至2012 年12 月31 日止。

5.1 Term of tenancy is from 01 / 01 / 2012 (DD/MM/YYYY) to 31 / 12 / 2012

(DD/MM/YYYY), totaled one years.

5.2租赁期满,甲方有权收回该物业,乙方应如期交还;如甲方该物业继续出租或出售,乙方在同等条件

下享有优先承租或购买权,但必须在本合约期满前一个月向甲方提出书面申请。

5.2 Party A has the right to take back the premises and Party B shall move out when this agreement expires.

Provided Party A continues to offer it for sale or for lease, Party B has a preemption right over other persons to purchase or rent the premises in the same conditions but he shall apply in written form one month before the expiration of this agreement.

六、租金:The rental:

6.1租金每月为人民币叁万柒仟元(小写¥:37,000 );每月租金须于1日之前交付甲方。

不包括税费,不包括管理费,水电,燃气,维修等杂费。

6.1 The monthly rental of the premises is calculated on gross floor area, i.e. RMB 37,000 per month, which

shall be paid on or before 1st. each month.。Not including the tax fee, manage fee, electricity fee and water fee.

6.2押金:签订本合约之同时,乙方即时向甲方支付贰个月押金人民币柒万肆仟元和

壹个月租金人民币叁万柒仟元,共计人民币币拾壹万壹仟元整(小写:¥111,000 )交予甲方,甲方应开具收据。

6.2 Deposit: when signing this agreement Party B shall immediately pay Party A two months of rental

74,000 as deposit and one months of rental 37,000 , totaled RMB 111,000 and Party A shall offer the receipt.

6.3租赁期间,每月的管理费、电话费、煤气费、清洁费、水电费、有线电视费、室内设施的维修等杂费,

均由乙方支付。

6.3 During the Term of Tenancy, Party B shall not transfer the premises to any other persons without the written

consent of Party A. And Party B shall bear such utilities chargers like management fee, telephone, gas, sanitation, water, electricity, maintenance of interior facilities and so forth.

七、押金:Deposit:

7.1合同期满,乙方如不再续租,在乙方将该物业及各种设施交还甲方后,甲方应将押金退还乙方(不计利息)。

7.1 Party A shall refund the deposit to Party B (without interest) when this agreement expires, after Party B in the property and facilities to party A ,if Party B doesn’t continue to rent the premises.

7.2乙方若于租赁期内违反本合约之规定,致使甲方未能如期收取租金或因而发生费用,甲方可以扣除部

分或全部押金抵付。若押金不足以抵付有关费用,乙方需按接到甲方付款通知书十天内补足。

7.2 Provided Party B violates this agreement during the Term of Tenancy and causes Party A to fail to collect the

rental at fixed date or suffer other losses, Party A is entitled to forfeit partial or total deposit as compensation.

If this amount of money is less than the relevant sum, Party B shall pay the balance within ten days after receiving Party A’s written notice.

八、双方责任:Responsibilities of two parties:

8.1租赁期间,乙方如对该物业及其设施故意或过失损毁,应负责修缮和恢复原状或赔偿经济损失。

8.1 Party B shall be responsible for the maintenance or reinstatement or compensation for the damage or fault of

the premises or the facilities caused by Party B’s abnormal or unreasonable uses during the Tenancy Term.

8.2乙方使用该物业时,不得擅自改变结构和用途,不得储存任何违禁品、易燃品、爆炸品等物。同时必

须严格遵守中华人民共和国法律和当地的有关规定,遵守社会公德。

8.2 Party B shall not change the structure or the usage of the premises, not store any forbidden, inflammable and

explosive materials in the premises during the Tenancy Term. And Party B shall keep in conformity with relevant P. R. C. and local laws, the regulations and the rules as well as social moral norms.

8.3租赁期间,乙方不按时交租,甲方应及时发出催租通知书。乙方如拖欠租金达十日或欠交管理费、水

电费等达两个月视为乙方违约,甲方有权单方面终止合同。乙方须全部承担因违约所造成的责任。

8.3 Provided Party B refuses to pay the monthly rental on or before the fixed date during the Tenancy Term, Party

A shall immediately inform Party

B in written form. If Party B refuses to pay the monthly rental for ten days

later or management fee, water and electricity for two months, Party B will be regarded as having violating this agreement and this agreement will be automatically terminated and all responsibilities hereafter caused shall be borne by Party B.

8.4因乙方违约而合约终止,甲方有权不经乙方同意单方收回该物业,乙方须无条件立即迁出该物业。

8.4 Party A has the right to take back the premises without Party B’s consent and Party B shall immediately move

out the premises if this agreement is terminated by Party B’s violation.

8.5租赁期内,未经乙方同意,甲方不得提前收回该物业,如有违约,甲方须赔偿乙方由于提前退房而造

成的一切损失。

8.5 Party A shall not take back the premises without Party B’s consent during the Tenancy Term, otherwise any

loss hereafter caused shall be borne by Party A.

8.6租赁期内,甲乙双方应遵守租金数额的约定,不得擅自要求提高租金或降低租金(征得对方书面同意

的除外),若因此要求未获对方同意要求解约的,则视为违约。

8.6 Party A and Party B shall bear the agreement of the amount of the rental, and shall not raise or diminish the

rental without the consent of the other party, otherwise shall compensate losses.

九、佣金:Commission:

基于经纪方在促进租赁中所提供之服务,于签署本合约同时,甲方同意支付给经纪方人民币:壹万捌仟伍佰元(小写:¥18,500 元)作为佣金;乙方同意支付给经纪方人民币:壹万捌仟伍佰元(小写:¥18,500 元)作为佣金。

Party A agree to pay a sum of RMB 18,500 and Party B agree to a sum of RMB 18,500 respectively as commission to The Agent at the date of this agreement is signed owing to his professional services provided to two parties.

十、其他:Others:

10.1本合约如发生纠纷,甲、乙双方应通过友好协商解决,不能解决时即可向深圳仲裁委员会提出仲裁,

该委员会之裁决结果对双方均有约束力。

10.1 Provided that any dispute between two parties arise in the course of execution of this agreement two parties

are obliged to solve it by further negotiation. Should negotiation fail they can apply to Shenzhen Arbitration Committee to arbitrate the dispute, which will take possible measures with equal force of constraint on two parties.

10.2本合同用中、英文书写,如果英文本与中文本不一致,则以中文本为准。本合同共叁份,自双方代表签字(盖章)之日起生效。

This Contract is executed in two counterparts each in Chinese and English. If the text in English and inconsistent ,the Chinese version shall prevail. This Contract is in three copies, effective since being signed/sealed by both parties.

十一、备注(Remarks):

1.此房现状出租,详见家私清单,乙方可以使用冰箱、烘干机、洗衣机等家私电器,其他用不到的家私电

器,乙方可以存放到地下室房间里。The real situation of rental, see the list of the furniture, Party B can use refrigerator, dryer and wash machine etc. ,other furniture ,Party A can put in a small room on the second undercroft.

甲方需在2012年1月1日前重新刷新墙面,维修地下室的天花板,并检修所有家私电器。Party A painting the wall , repair of basement ceiling and checking everything is working before 01/01/2012 .

2.甲方配合乙方到租赁所缴税,租赁费用由乙方承担。Party A can coordinate Party B go to the lease

government to pay the tax.,Party B will pay the tax fee.

4.上述房屋租期为壹年,若乙方在租赁期内退租,甲方有权没收押金。Term of tenancy is one year, if Party B early termination of contract, Party A will confiscate the deposit.

5.租赁期满,甲方有权收回全部出租房屋,乙方应如期交还。乙方如要求续租,须在本合同期满前两个月前通知甲方,双方另行诚意协商续租。 The expiry of the lease, Party A shall have the right to recover the full rental housing, Party B shall be returned. Party B requires renewal, must be in the contract expiry date two months prior notice to Party A ,both sides will negotiate in good faith to renew.

6.附件:租赁物业物品交接清单。Attachment : Rental property goods delivery list.
